RELEASE

Sender understands that the Material is submitted on the following terms and conditions:

1. Sender submits the Material in accordance with, and will full knowledge of, the rules of the ABS-CBN
“Video Send-In Promo” for the “Team Kapamilya Campaign” (the ‘Campaign”)

2. Sender understands that ABS-CBN will refuse to accept or otherwise evaluate the Material for possible
use and inclusion in the Campaign in the absence of Sender’s acceptance of the terms of this Release.

3. Sender acknowledges that the Material is submitted in consideration for its possible inclusion in the
Campaign, and that if the Material is selected by ABS-CBN, Sender shall receive promotional items of
the Campaign as prize (the “Prize”).

4. Sender acknowledges that except for the Prize if the Material is selected by ABS-CBN for use and
inclusion in the Campaign, submission of the Material alone does not entitle Sender to any
consideration or prize.

5. Sender understands that the Material, once submitted to ABS-CBN, shall become the property of ABS-
CBN and shall not be returned. Sender further acknowledges that the Material may be edited or
modified by ABS-CBN as it may deem appropriate, and that ABS-CBN may use the Material or any
portion thereof, in any manner in any and all media in any territory worldwide.

6. Sender represents and warrants that:

a. Sender is the sole and present owner of all right, title and interest in and to the Material;
b. Sender has the exclusive, unconditional right and authority to submit the Material to ABS-CBN and
grant the rights herein granted to ABS-CBN;
c. All necessary consents, permissions and licenses have been obtained from all persons, locations
and entities depicted or otherwise included in the Material (the “Subjects”), and that the Subjects
have consented to, and have authorized Sender to represent them in conveying such consent, for:
their inclusion in the Material; the submission of the Material to ABS-CBN; and the grant of the
rights herein granted to ABS-CBN, and that no other permissions shall be required from the
Subjects or any other party.
d. The Subjects shall not assert any claim against ABS-CBN based on publicity rights, privacy rights,
defamation, property rights, infringement of copyright, or any other right, arising out of the
submission to, and inclusion of, the Material in the Campaign, or any other cause of action arising
out of the production, duplication, distribution, broadcast or exhibition of the Material.

7. In consideration of the inclusion of the Material in the Campaign, and the Prize, Sender hereby releases
and agrees to hold harmless ABS-CBN, its parent company, subsidiaries, and their respective officers,
stockholders, directors, employees from and against any and all claims, expenses, losses, or liabilities
that may be asserted against ABS-CBN by the Subjects or any other party at any time in connection
with the Material, or any use thereof, and from any breach of Sender’s warranties herein.

8. This Release shall inure to the benefit of ABS-CBN, its subsidiaries and related companies, their
respective assigns and licensees, officers, stockholders, employees, agents and representatives.
