In Memory of Daniel J. McAulie 1945 - 2010


Daniel J. McAulie, sole author of the Arizona Civil Rules Handbook for the last fteen years, passed away in March 2010. He was an extraordinarily gifted lawyer and author. In that latter regard, Dan left a legacy of six books on civil procedure, evidence and ethics, which reside the bookshelves of practitioners and members of the judiciary alikeat least when the books aren't being used! Dan was born in New York City in 1945. He graduated at the top of his class at Regis High School, one of New Yorks most prestigious high schools and then attended Fordham University, graduating Phi Beta Kappa, with a major in Russian. He attended Harvard Law School, graduated in 1969 with honors and then went to work with the U.S. Department of Justice in Washington, D.C. In 1973, he left his position in Washington D.C. with the U.S. Department of Justice to join Snell & Wilmer in Phoenix, Arizona. While Dan was an accomplished lawyer and author, he also was committed to giving of his time and talent to his community and the legal profession. Dan served on countless community and professional committees concerned with legal reform and public access to justice. He chaired the Arizona State Bars Professionalism Course Committee. He served several terms on the Arizona State Bars Board of Governors and then led the State Bar of Arizona as its President from July 2007 to June 2008. In 2009, the Arizona State Bar recognized Dans substantial contributions and accomplishments when the State Bar renamed its continuing legal education conference center in Dans honor. The center is now known as the Daniel J. McAulie CLE Conference Center. Dan was a true legal giant, who was generous with both his time and his talent, and he was a good, honest man with an unforgettable laugh. Dan was the best of the best; rst among equals. And, he is sorely missed by all of us who knew, respected and loved him.

PREFACE
The 2011 Edition of the Arizona Civil Rules Handbook adheres to the time-tested goal and standards established almost two decades ago by Daniel J. McAulie. Thus, as it was for prior editions, the goal of this Handbook is to provide Arizona practitioners, and judges alike, with a basic tool in the conduct of a civil litigation practicea readily available source of answers and/or explanations for the questions that most frequently arise in the conduct of a civil case, in a one-volume work that can be used as readily in the courtroom as in the oce. The 2011 Edition incorporates the text of the Arizona Rules of Civil Procedure, including amendments through January 1, 2011, and the structural changes to the civil procedural rules that took eect on December 1, 2000. In that latter respect, earlier editions of this Handbook contained the text of, and accompanying narrative concerning, the ve sets of procedural rules with the most frequent and broad-based impact on the conduct of civil litigation: the Arizona Rules of Civil Procedure, the Uniform Rules of Procedure for Arbitration, the Uniform Rules of Practice of the Superior Court, the Uniform Rules of Practice for Medical Malpractice Cases, and the Arizona Rules of Evidence. By Order entered in October 2000, the Arizona Supreme Court abrogated, eective December 1, 2000, three of these ve sets of rules: the Uniform Rules of Procedure for Arbitration, the Uniform Rules of Practice of the Superior Court, and the Uniform Rules of Practice for Medical Malpractice Cases. The provisions of these sets of rules did not disappear, however, their provisions were, for the most part, incorporated into either the Arizona Rules of Civil Procedure or the Rules of the Arizona Supreme Court. The rationale employed for deciding on the placement of the abrogated rules was that rules which concerned the processing of a civil case should be placed in the Arizona Rules of Civil Procedure, while rules that were concerned primarily with internal court administration should be placed in the Rules of the Arizona Supreme Court. Consistent application of this rationale led to the transfer of certain provisions of the Arizona Rules of Civil Procedure (primarily Rules 77 and 79) to the Rules of the Arizona Supreme Court. The 2011 Edition incorporates all these changes, and contains, with respect to each rule aected, an explanation of the changes

that were made. As with past editions, this edition contains the 2000 Civil Rules Correlation Table, approved by the Supreme Court, which shows the new location of all the rules that were transferred as part of this consolidation process undertaken in 2000. The 2011 Edition also contains citations to, and/or discussions concerning, pertinent case authority published through March 2011 construing and/or applying the Rules. Such case updates, of course, are subject to the limitations imposed by the fact that published material appears at a discrete point in time, while the development of the law, particularly in the procedural arena, remains ongoing and dynamic. For that reason, those who use this work in their practice are reminded to cite check and update all information before relying on that information. In short, this Handbook is a starting point for further research, not the end point. In closing, I reiterate the long-standing invitation to readers to provide comments and suggestions for items to be included or discussed in this work. I encourage those judges and lawyers who use the Handbook to continue to provide suggestions and comments and will take all such suggestions and comments into account in future editions of this Handbook.
