DONNA M. DAVIS Page Two (Woolls & Peer contd) Developed a theory of how contribution toward defense, indemnity and additional insured defense should be calculated, using a detailed spreadsheet-based system to facilitate analysis of the potential defenses to and values of each individua l underlying action in large contribution actions, minimizing the amount clients ultimately paid in settlements. Also, by showing viable defenses to each clai m the spreadsheet system also proved critical in convincing opposing counsel to dismiss large numbers of underlying actions as non-viable. The trial court fai led to comprehend the math and ordered an inequitable 50-50 split for each viabl e underlying action. On appeal, our client prevailed on the issue of how contri bution should be calculated, and in a detailed published opinion the Court agree d 100% with my theory. Analyzed potential insurance coverage in landlord-tenant disputes, defamation ac tions, patent disputes and Toxic Tort actions. Prepared coverage opinions. Defended the insured and brought actions on behalf of the insured after automobi le accidents. Prepared and challenged initial pleadings and was responsible for all aspects of pre-trial litigation, including discovery, discovery motions, document analysis , depositions and retaining and preparing expert witnesses. Persuaded opposing counsel to dismiss an entire contribution action originally v alued at $1+M by sharing my comprehensive spreadsheet analysis with opposing cou nsel. Conducted extensive research and analysis in insurance bad faith actions brought by purported additional insureds, which frequently convinced plaintiffs counsel to either dismiss our client or reach a favorable settlement early in the litig ation.
