East: CEI transmission lines and two-story commercial building; zoned B-2, General Business. West: Penn Station restaurant; zoned B-2, General Business. Zoning History: The auto dealership was constructed in 1970, the most recent auto dealership operator (Clarke Dodge) was granted a transfer of the CUP in July, 2000. In 2008, the Planning Commission approved the transfer of the Auto Dealership conditional use permit for a motorcycle, ATV & scooter dealership (LC Motor Sports) in a portion of this building and two (2) conditional use permits for a vehicle service business in the rear of the building and a rental car facility. In September 2007, the Board of Building and Zoning Appeals approved a variance to permit a free-standing sign setback of 9.5 from the front property line. No signage has been installed to date. Engineering Comments: 1. A Building Permit is required for interior alterations and additions. Plans shall be submitted for permit review by the Chief Building Official for conformance with the Ohio Building Code and necessary permits obtained. Fire Department Comments:

1. The warehouse will require sprinkler protection if over 12,000 sq. ft. 2. If sprinkler protection is required, a Knox Box Entry system will be required; otherwise we would request a Knox box. 3. Access to the rear of the structure appears very limited from the west side of the building; the Fire Department will require better access. 4. A fire panel will be required to monitor the sprinkler system, if that system is required. Police Department Comments: No specific comment Analysis: The applicant proposes to operate a wholesale and warehousing distribution plumbing supply company from a vacant building located at 7272 Mentor Avenue. The family owned business has operated in northeast Ohio since 1932. Cleveland Plumbing Supply Company provides wholesale services to plumbing, heating and fire protection industries through six locations in northeast Ohio. Three of their locations, including Mentor, have showrooms which display fixtures offered for sale by the company. The applicant is currently leasing space on Tyler Boulevard and has been located in the City since 1982. The applicant is proposing to purchase the property and expand the business with a retail showroom and additional space for warehousing. The hours of operation for the showroom will be from 7:30 A.M. until 4:30 P.M. weekdays. They currently have eight (8) employees working in Mentor with a total of 58 employees at all of their locations. The business plans to relocate their office and support staff to the Mentor location at a later time. The applicant proposes to install a secured fence at the rear of the building for the storage of long lengths of pipes and crated products. This area was originally used in the 1970s as a gravel storage lot for the Coleman-Young Dealership and had a chain link fence with white slats along the rear property line. The proposed storage area is unkempt and will need to be cleaned up. The storage lot will be screened with 80-ft. of board on board fence ten (10)-ft. in height along the sides visible from Mentor Avenue and the remainder of the fencing ten (10)-ft. high chain link. Per Chapter 1162 Landscaping Screening and Buffering, service structures, loading facilities and various containers shall be screened from off site views with either landscaping or fencing which is a foot higher than the item which is being screened. An existing stand of deciduous trees provides adequate screening of the rear and west side property line when the trees are foliated. The applicant is advised that the maximum height of the racks and pallets within the storage yard shall be nine (9)-ft. The applicant is also seeking a conditional use permit for a reduction to the buffer requirement to the adjacent vacant residential land to the south as required per Chapter 1162 Landscaping Screening and Buffering. Warehousing and storage uses when located next to residential properties require a minimum 25-ft. set back and landscape planting consisting of 13 canopy trees, 18 under story trees, 69 shrubs, 36 evergreens and a either a eight (8) foot solid wood fence or masonry wall or a six (6) foot Berm (with a 3:1 slope). The storage lot is located the minimum 25-ft. distance from the residential property. The applicant wishes to maintain the existing deciduous tree line along the residential property and install a chain link fence. The Administration does not object to maintaining the existing deciduous vegetation. Stipulations: Wholesaling and Warehousing 1. The storage yard shall be fenced with a 10 board-on-board fence along the Mentor Avenue frontage and a portion of the sides storage height shall be one (1)-ft. less than the height of fencing. 2. This permit shall also include the applicant and property owner, Bart Morvilius of The Cleveland Plumbing Supply Company and shall not be transferable without the approval of the Planning Commission.

This permit shall be null and void if the use for which it is granted does not commence within twelve (12) months of the date of issuance or if said use is abandoned for a period of six (6) months or more following its establishment. 4. This permit may be revoked by the Administrator and/or Planning Commission for violation of any of the above conditions or any of the provisions of the zoning code. Appeals of the Administrator's decision to revoke the permit shall be made to the Planning Commission. Such appeals must be filed with the Economic & Community Development Department within ten (10) days of receipt of the notice of revocation Buffering: 1. The storage yard shall be fenced with a 10 board-on-board fence along the Mentor Avenue frontage and a portion of each side. Storage height within this area shall be one (1)-ft. less than the height of fencing. 2. The existing deciduous trees and shrubs within the 25 foot setback area shall be maintained. 3. This permit shall also include the applicant and property owner, Bart Morvilius of The Cleveland Plumbing Supply Company and shall not be transferable without the approval of the Planning Commission. 4.
