Fair Use Copyright

Definitions:
Copyright - Legal protection of original works of authorship.
Fair Use - The ability to use brief excerpts of copyrighted material
without the permission of the owner under certain circumstances (e.g.
education, reporting, criticizing, commenting, and parodying) as long as
one properly gives credit to the owner.

Copyright infringement & Legal


Repercussions:
Infringement: When you steal and use anothers work without their
permission.
Legal Repercussions:
Fees for damages and profits ranging from $200-$150,000 for each
infringed work
Fees for attorneys and court costs
Courts can put an end to infringing acts
Illegal works can be impounded
Jail time for infringer

Fair Use:
If you do not own the copyright, license, or have direct permission, you
may still be able to use brief excerpts of original material if the purpose
of usage falls within five categories:

Education, Reporting, Criticism, Humor/Satire,

Reporting - Used to communicate and convey information, usually

Criticizing/Critique - Used when analyzing or evaluating copyrighted

Considerations for Fair Use


1. Purpose and character of the use,
including whether the use is of a
commercial nature or is for nonprofit
educational purposes
2. Nature of the copyrighted work
3. Amount and substantiality of the portion
used in relation to the copyrighted work
as a whole
4. Effect of the use upon the potential
