MASTER TEACHER II

for Secondary Education or any Bachelors degree with 18 professional
units in education plus complete academic requirements for Masters

RULE XVI
LEAVE OF ABSENCE
> Leave of Absence is generally defined as a right granted to officials
and employees not to report for work with or without pay as may be
provided by law and as rules prescribed in the Rule XVI on Omnibus Rules
on Leave.
Entitlement to leave of privileges.- In general, appointive
officials up to the level of heads of executive departments, heads of
departments, undersecretaries and employees of the government
whether permanent, temporary or casual, who render work during the
prescribed office hours, shall be entitled to 15 days vacation and 15 days
sick leave annually with full pay exclusive of Saturdays, Sundays, Public
Holidays, without limitation as to the number of days vacation and sick
leave that they may accumulate.
Teachers Leave - Teachers shall not be entitled to the
usual vacation and sick leave credits but to proportional
vacation pay (PVP) of 70 days of summer vacation plus 14
days of Christmas vacation. A teacher who has rendered
continuous service in a school year without incurring
absences without pay of not more than 1.5 days is
entitled to 84 days of proportional vacation pay.
Teachers who are designated to perform non-teaching
functions. Teachers who are designated to perform
non-teaching functions and who render the same hours of
service as other employees shall be entitled to vacation
and sick leave.
Vacation Service Credits of teachers. Teachers
vacation service credits refer to the leave credits earned
for services rendered on activities during summer or
Christmas vacation as authorized by proper authority.
These vacation service credits are used to offset absences
of a teacher due to illness.
Activities Eligible for Teachers Service Credits
a. Services rendered during registration and election days as long
as these are mandated duties under existing laws;
b. Services rendered during calamity and rehabilitation when
schools are used as evacuation centers;
c. Services rendered in connection with the conduct of remedial
classes during summer or Christmas vacation or outside of
regular school days;
d. Services rendered in connection with early opening of the
school year;
e. services rendered during school sports competitions held
outside of regular school days;
f. Services rendered by those who train teachers in addition to their
normal teaching loads;
g. Teaching overload not compensated by honoraria;
h. Teaching in non-formal education classes in addition to teaching
in formal education classes carrying a normal teaching load;
i. Work done during regular school days if these are in addition to
the normal teaching load;
j. Conduct testing activities held outside of school days; and
k. Attendance/ participation in special DepEd projects and activities
which are short-term in duration such as English, Science and
Math mentors Training, curriculum writing workshop, planning
workshop, etc., if such are held during the summer vacation or
during weekends.
Activities Not Eligible for the Grant of Service Credit
a. In-service training programs fully funded by the
government;
b. assignment to clerical work, such as checking forms
and finishing reports commonly required in
connection with the opening and closing of classes;
c. reassignment of teachers to duty in another bureau
or office;(detailed in another government office)
d. assignment in connection with exhibits at a fair;
e. postponement of a regular teachers vacation; and
f. time spent in travelling to and from station to the
place where services are rendered.
Request for Special Order for service credit should
have the following attachments:
a. DepEd Order/ Division Memo stating that the
participants on the said training are entitled of
service credits.
b. Form 48 duly signed by the head of the
trainer.
c. List of participants should tally to the
submitted Form 48 of the participants. Duly signed
by the head of the trainer.
Other Rules
One work day of vacation service credit is granted for one day (eight hours)
of service;
The number of days of vacation service credits granted to a teacher shall not
exceed 15 work days in one year.
In the monetization of teachers leave credits, unused vacation service
credits shall be converted into vacation-sick leave credits. After
monetization, the remaining vacation-sick leave credits shall be converted
back to vacation service credits.

2. SICK LEAVE refers to leave of absence granted
only on account of sickness or disability on the part of the
employee concerned or any member of his immediate
family.

Shall be made on a prescribed form and shall be filed immediately


upon employees return from such leave however notice of advise
shall be sent to the immediate supervisor. Application for Sick Leave
in excess of 5 days shall be accompanied by medical certificate

may undergo medical examination or operation or advise to rest in
view of ill health supported by medical certificate
3. REHABILITATION LEAVE FOR JOB
RELATED INJURIES
Applications of employees for leave of absence
on account of wounds or injuries incurred in the
performance of duty. It must be supported by
the proper medical certificate and evidence
showing that the wounds and injuries were
incurred in the performance of duty.
4. MATERNITY LEAVE
Refers to leave of absence granted to female government employees legally
entitled thereto in addition to vacation and sick leave. The primary intent or
purpose of granting maternity leave is to extend working mothers some
measures of financial help and to provide her a period of rest and
recuperation in connection with her pregnancy.
Sec. 11. Conditions for the grant of maternity leave. Every woman in the
government service who has rendered an aggregate of two (2) or more years
of service shall be entitled to maternity leave of 60 calendar days with full
pay.
Maternity leave of those who have rendered 1 year or more but less than 2
years of service shall be computed in proportion to their length of service but
for those who have served for less than 1 year shall be entitled to half pay.
Every woman, married or unmarried, may be granted maternity leave more
than once a year. - Maternity leave shall be granted to female employees in
every instance of pregnancy irrespective of its frequency.
MATERNITY LEAVE COMPUTATION

5. PATERNITY LEAVE
Refers to the privilege granted to a married male employee
allowing him not to report for work for seven (7) working days
while continuing to earn the compensation thereof, on the
condition that his legitimate spouse has delivered a child or
suffered a miscarriage, for purposes of enabling him to effectively
lend care and support to his wife before, during and after childbirth
as the case may be and assist in caring for his newborn child.
Conditions for the grant of paternity leave.

6. PARENTAL LEAVE FOR SOLO PARENT

Shall refer to leave benefits granted to a solo parent to enable


said parent to perform parental duties and responsibilities
where physical presence is required.
* CSC MC No. 8,s.2004 The parental leave of seven (7) days in
addition to existing leave privileges shall be granted to any solo
parent employee.
The following are categorized as Solo Parent for availment of
Parental Leave:
1. A woman who gives birth as a result of rape and other crimes
against chastity, even without a final conviction of the offender:
Provided, that the mother keeps and raises the child.
6. PARENTAL LEAVE FOR SOLO PARENT

2. Parent left solo or alone with the responsibility of parenthood


due to any of the following circumstances:
2.1 death of spouse;
2.2 detention of the spouse or serving sentence for a criminal
conviction for at least one (1) year;
2.3 physical/ mental incapacity of spouse as certified by a
public medical practitioner;
2.4 legal separation or de facto separation from spouse for at
least one year provided he/she has custody of the children;
Declaration of nullity or annulment of marriage as decreed by
a court or by a church, provided, he/she has custody of the
children and
2.6 abandonment of spouse for at least one year.
7. SPECIAL LEAVE PRIVILEGES
Refers to leave of absence which officials and employees may avail of for
maximum of three (3) days annually over and above the vacation, sick,
maternity and paternity leaves to mark personal milestones, parental
obligations and/ or attend to filial and domestic responsibilities, personal
transactions, calamity, accident and hospitalization. (except teachers)
Subject to the following conditions:
(1) Personal milestones (b-days/wedding/ wedding anniversary/death
anniversary.
(2) Parental Obligations (PTA meetings/ graduations/ first communion/ medical
needs)
(3) Filial obligations (moral obligations towards his parents or siblings for their
medical or social needs)
(4) Domestic Emergencies (sudden urgent repairs at home, sudden absence of a
yaya)
(5) Personal transactions (paying taxes, court appearances, arranging a house
loan)
8. STUDY LEAVE
It is a time off from work not exceeding six (6) months with pay for
the purpose of assisting an employee to prepare for his BAR or
board examinations or to complete his Masters degree. Those in
the teaching profession are not entitled to the study leave
privilege. (CSC MC No.41,s.2004)

QUALIFICATION REQUIREMENTS:
1. Graduated with a bachelors degree which consequently requires the passing
of government bar and board licensure examination;
2. For thesis writing or comprehensive examination;
3. The profession or field of study to be pursued must be relevant to the agency
or to his official duties and responsibilities;
4. He must be a permanent employee;
5. He must have rendered at least two (2) years of service with at least very
satisfactory performance for the last two (2) rating periods immediately preceding
the application;
6. He must have no pending administrative and criminal charges;
7. He must not have any current foreign or local scholarship grant; and
8. He must have fulfilled the service obligation of any previous scholarship and
training contract. The service obligation must be on the basis of the following

1. Any female public sector employee, regardless of age
and civil status, shall be entitled to a special leave of
maximum of two (2) months with full pay based on her gross
monthly compensation, provided she has rendered at least
six (6) months aggregate service in any or various
government agencies for the last twelve (12) months prior to
the undergoing surgery for gynecological disorders. (The
special leave may be availed for every instance of gynecological
disorder requiring surgery for a maximum period of two (2)
months per year.

10. TERMINAL LEAVE
Terminal leave is applied for by an official or an employee who intends to
sever his connection with his employer. The filing of application for terminal
leave requires as a condition for the employees resignation, retirement or

Effect of failure to report to duty after expiration of one
year leave.
If an employee who is on leave without pay fails to
report for work at the expiration of one (1) year from the

An employee who is continuously absent without
approved leave for at least 30 working days shall be
considered on absence without official leave (AWOL) and
shall be separated from the service or dropped from the
rolls without prior notice.

Revised Guidelines on the
Transfer of Teachers from One
Station to Another
Transfers may be made even without the consent of the
teacher:
a. When the pupil-student teacher ratio of the school is
below 35:1 for Elem and 27:1 for secondary level except when
the school is implementing multigrade classes;
b. When there is a considerable decrease in enrolment in
certain schools arising from evacuation due to armed conflict,
national disaster, resettlement of families, closure of large
private firms in the area and other similar circumstances or
c. when the teacher is declared excess by the principal or
school head and his or her expertise/area of specialization is
needed in another school, district or division.
Teachers are transferred in the exigency of the service, the
following may serve as a guide in the decision on whom to
transfer:
a. Teachers who were last to be hired (Last in, First out)
b. Non-residents of the barangay or municipality where the
school is located;
c. Residents of the barangay or municipality of the
proposed recipients school or
d. Secondary school teachers teaching subject other than
their areas of specialization.
The following situation should be given priority when
teachers are seeking transfer to another station which is
in need of additional teachers:
a. When the teacher is declared excess by the SH and or
his - her expertise/area of specialization is needed in
another school/district/division;
b. The teacher has served for more than 5 years outside
his/her home barangay/municipality.
c. The teacher is a bonafide resident of the barangay,
municipality, city, or province where the school is located
(RA No. 8190, Localization Law) as evidenced by the
teacher's Voter's ID;
d. The teacher is joining his/her husband/wife in the
same school (RA No. 4670)
e. She is a nursing mother (PD No. 603, Child and Youth
Welfare Code)
f. The teachers life is in danger due to armed conflict,
hostilities or other similar circumstances in the area where
the school is located.
g. He/She is in poor health condition as evidenced by
pertinent medical records to that effect.

Personal Relief Allowance (PERA)

from government service before October 31 of the same year shall be granted
within the month of retirement or separation, a prorated share of the :
a) Year-End Bonus based on the monthly basic pay immediately preceding the
date of retirement or separation; and
b) Cash gift of Php 5,000 as follows:

- Equivalent to one month salary as of May 15 subject to the
following conditions:
1. Personnel has rendered at least a total or an aggregate of
four months of service from July 1 of the immediately
preceding year to May 15 of the current year.
2. Personnel remains to be in the government service as of
May 15 of the current year.
3. Personnel at least a Satisfactory Performance Rating
immediately preceding rating period.
- The MYB of personnel who transferred from one agency to
another shall be paid by the new agency.

- Those who are formally charged administrative and/or


criminal cases which are still pending for resolution, shall be
entitled for mid-year bonus until final and executory
judgment.
1. Those found guilty shall not be entitled to MYB in the
year of finality of the decision. The personnel shall refund the
MYB received for that year.
2. If the penalty imposed is only a reprimand , the
personnel concerned shall be entitled to the MYB.
Clothing Allowance
- The annual clothing and uniform allowance shall be released in cash amount
of Five Thousand Pesos (P 5,000) to the teachers and non-teaching personnel.
- A newly hired employee may qualify to the grant of uniform and clothing
allowance after rendering six (6) months of service and if expected to render
services for at least six (6) months for the rest of the year.
Cash Allowance
- Cash allowance to teachers for the purchase of chalks, erasers, forms and
other classroom supplies and materials amounting to One Thousand Pesos (P
1,500).
Productivity Enhancement Incentive (PEI)
- To be entitled to the PEI of Php 5,000.00
a.) Employees must have rendered at least a total or an aggregate four (4)
months of service as May 31 of each year, including leave of absence with pay and
who are still in the service as of May 31; and
b.) obtained at least a satisfactory performance rating.
Performance Based Bonus (PBB)
- Employees holding regular plantilla positions are qualified for PBB based on
the following:
a.) Personnel who have rendered at least nine (9) months of service for the
year ending March 27 of the current year for teaching personnel including ALS or
Mobile teachers and for the year ending December 31 of the previous year for
non-teaching personnel shall be entitled to the full amount of the PBB.
b.) Employees who have rendered a minimum of three (3) months but less
than nine (9) months of service shall be eligible for the grant of PBB on a pro-rata
basis.

c.) Should have at least a rating of satisfactory performance.
Special Hardship Allowance/ Hazard Pay
- Personnel entitled to Special Hardship Allowance
a.) Classroom teachers in elementary and secondary schools and
school heads/ administrators assigned to a hardship post;

SHA = (Basic Salary x Rate per distance) x number of days present
in a month over number of working days in a month
b.) Multi-grade teachers;

c.) Mobile teachers; and


d.) Alternative Learning System (ALS) Coordinators
Handling 1 learning level 15 % of basic salary
Handling 2 different learning levels 20% of basic salary
Handling 3 or more learning levels 25% of basic salary

GUIDELINES for the Correction of Entries in the School
Permanent Records of Students:

1. The Request for Correction of Entries in the School


Permanent Records of Students must be filed, submitted and
processed at the Regional Office Legal Unit.

2. It must be processed personally by the person owning the


School Records or if he wishes to authorize another person,
he/she must make an authorization Letter and shall present a
valid Government issued IDs with photograph and signature of
the requestee and the authorized representative.
GUIDELINES for the Correction of Entries in the School Permanent
Records of Students:

3. He must bring with him all the original copies of documentary


requirements and two (2) sets of photocopies.

4. A RESOLUTION or written authority given to the School Heads


to effect the changes in the school records of students will be
issued by the Regional Director.

5. Resolution shall be forwarded to the School concerned by the


Requestee.

6. The School Head shall issue the corrected School Records.


NOTE: The School Head cannot make the necessary changes in the School
Records unless there is a RESOLUTION issued by the Regional Office.

DOCUMENTARY REQUIREMENTS:
1. Letter Request for the Correction of Entry in the School Permanent Records
2. Joint Affidavit of Two disinterested persons (not related to the requestee)
attesting to the fact that the assumed (erroneous name appeared in the school
record and the legal name appearing in the birth certificate is ONE and the SAME
PERSON.
3. Original Copy of Birth Certificate issued by the Local Civil Registrar authenticated
by Philippine Statistics Authority (PSA) formerly NSO.
4. School Records bearing the erroneous (assumed) name like Diploma, Form 137-E,
Certification of Graduation and List of Graduates.
5. Affidavit of Loss If the Diploma/School Records have been lost or destroyed
6. Authorization Letter and Valid Government IDs if will authorize someone to
submit
7. ALL THE DOCUMENTS required must be in the ORIGINAL
8. MUST BRING two (2) sets of Photocopies of the Original Documents as required.
